USPS age discrimination case reaches Supreme Court

USA Today reports that the Supreme Court has agreed to hear an appeal in the case of Myrna Gómez-Pérez vs. the US Postal Service. Gomez-Perez claimed that she was harassed after she filed an age discrimination complaint against the USPS. An Appeals Court ruled that while the law prohibits age discrimination, it does not prohibit retaliation against employees who file discrimination claims, a decision one commentator referred to as “startling”.

The case is not likely to be heard until the new year.

    There is probably no more brutal an employer then the USPS, when they have been investigated for their discrimination. Its hopeful that the supreme court do something to protect workers from retaliation;up to this point USPS must believe they are above the law.

    I think it will take more then a federal court to change the harrassment of postal workers by the USPS.

    You’re exactly right. It would take more than a federal court, it would take the slugs actually putting in 8 hours worth of work for 8 hours of pay to get the USPS to leave them alone. Errr, I mean stop the harrassment.

    Discrimination is wrong as is retaliation for filing a colorable EEO. But filing frivilious EEO complaints is also wrong and it is time for the law to change. If an EEO has merit, there should be no retaliation and anyone who does so should be disciplined themselves. But those who file EEO complaints when they have no basis, when they merely want to harass management and when they are total losers who don’t do their jobs but still want to be paid the wonderful salary and benefits the USPS offers it’s employees, then discipline up to removal ought to be allowed.
    In this case the US Supreme Court will rightly say that retaliation against someone who files an EEO claim will not be allowed. But the Court will then remand the case to the district court to determine if retaliation actually did take place, or if the alleged “retaliation” was merely management rightly trying to get a disgruntled employee to do their job. That is a question of fact that must be decided based on the evidence, not some pronouncement by a union or management official that a wrong has taken place.

    file a sex decrimination charge, a eeo complaint, or use the I’m over 55 rule and see who will come to your aid against the USPS.

    U. S. Postal Service management regularly abuses the older employees of the Post Office that I have worked at for 22 years. I believe it’s part of a concerted effort to
    force out the older, top salary level employees. You haven’t heard the last of this issue.

    It is about time the USPS gets what it deserves. I have been an employee for 12 years it was not until I had an acciddent that the hostility and abuse began. I am 57 years old and have done my job in the best possible manner. After filing a workers comp case for the first time and the local postmaster contesting my claim all bets are off. He has become hostile and abusive towards me and I have filed grievance after grievanace and filed formal complaints with the District, my congressman and senator, the EEOC on age and gender discrimination, OSHA and the National Labor Relations Board. District personnel will not acknowledge the hostility and abuse by this man who may some day hurt me physically. Just want to get it on the record should something happen to me at the hands of the Lake Havasu City Postmaster, in AZ. I am currently disabled and walk with a cane and a recent shoulder surgery and I struggle with asthma conditions. Yet this man uses me like a mattress or foot rest. His horrific temper and his past post traumatic stress as a marine in Vietman will some day lead him to physically hurt me. This has been brought to the attention of the Inspection Service and their postition they will do nothing until my blood is on the floor, then they will arrest him for battery. No amount of warning to all the previous organizations will change their position. Please let the world know this is going on in Lake Havasu City, Arizona with the postmaster Steve Gertls, who has an abusive personality.

    EEOC, EEO THEY ALL GIVE FAVOUR TO THE USPS. EEO IS A JOKE.
